Workers Compansation Appeals Trubunal

The Workers’ Compensation Appeals Tribunal (WCAT), under the legislative authority of the Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act is mandated to hear appeals under this Act, the Workers' Compensation Act, the Firefighters' Compensation Act and the Occupational Health and Safety Act. Independent from the Workplace Health, Safety and Compensation Commission or WorkSafeNB, the WCAT is a quasi-judicial administrative tribunal. If workers, their dependants or employers are dissatisfied with a decision made by WorkSafeNB, they can appeal the decision to the WCAT.

The WCAT's primary responsibility is to provide timely, fair, consistent and impartial decisions when resolving appeals of decisions rendered by WorkSafeNB.

The WCAT consists of a full-time chairperson and up to 10 part-time vice-chairpersons.

Chairperson:  The chairperson is appointed by the Lieutenant-Governor in Council and is responsible to the Minister for the operations of the Workers’ Compensation Appeals Tribunal.

Daniel R. Theriault Q.C. was appointed on May 28, 2015 for a 5-year term. He has been practicing law since 1988. He was previously in private practice, primarily in the Fredericton area, and also the public intervener from 2006 to 2011. He was appointed a Queens Counsel in 2008.

Vice-Chairpersons:  Not fewer than 5 and not more than 10 vice-chairpersons are appointed by the Lieutenant-Governor in Council to serve on a part-time basis to hear appeals.

The current vice-chairpersons are:

Anik Bossé – appointed April 2, 2015, for a 3-year term. Ms. Bossé has been practicing law since 2001 and resides in Edmundston.

Jennifer Cleversey-Moffitt – appointed April 2, 2015, for a 3-year term. Ms. Cleversey-Moffitt has been practicing law since 2004 and resides in Bathurst.

James A. Connely – appointed October 7, 2015, for a 3-year term. Mr. Connely has been practicing law since 1982 and resides in Edmundston.

Danys R. X. Delaquis – appointed October 7, 2015, for a 3-year term. Mr. Delaquis has been practicing law since 1998 and resides in Saint John.

Candace R. Salmon – appointed April 2, 2015, for a 3-year term. Ms. Salmon has been practicing law since 2011 and resides in Moncton.

James A. Whelly – appointed October 7, 2015, for a 3-year term. Mr. Whelly has been practicing law since 1982 and resides in Saint John.


In support of the WCAT’s activities, staff members work to review files, respond to enquiries, schedule hearings, prepare the necessary documentation and ensure decisions are sent to all parties concerned.
